Terms & EULA
These Terms of Service and End-User License Agreement (together, the "Terms") are a binding agreement between you and Hot Spots Technologies L.L.C-FZ ("Hot Spots," "we," "us"), the operator of the Hot Spots mobile application and related services (the "App"), governing your use of the App.
By creating an account or using the App, you agree to these Terms and to our Community Standards and Privacy Policy. If you do not agree, do not use the App.
1. Zero tolerance for objectionable content and abusive behavior
Hot Spots has zero tolerance for objectionable content and for abusive users. By using the App you agree that you will not create, post, share, upload, send, or transmit any content that is objectionable, and you will not behave abusively toward others. Objectionable content and behavior include (without limitation): harassment, bullying, threats, hate speech, discrimination, violence, sexually explicit material or nudity, child sexual abuse material, content sexualizing minors, spam, scams, fraud, impersonation, doxxing or sharing others' private information, and anything illegal. A full description is in our Community Standards, which are incorporated into these Terms.
Our commitment. We provide tools to filter content, report content or users, and block users. We review reports and act on objectionable content within 24 hours — we will remove the content and may suspend or permanently remove (eject) the user who provided it. We may take these actions with or without notice and at our sole discretion.
You agree that violating this Section is a material breach of these Terms.
2. Eligibility (16+)
You must be at least 16 years old to create an account or use the App. By using the App you represent that you meet this requirement and that the information you provide (including your date of birth) is accurate. We may remove accounts we reasonably believe belong to anyone under 16.
3. Your account
- You are responsible for your account, your credentials, and all activity under your account.
- Provide accurate information and keep it current.
- One account per person unless we expressly permit otherwise; business/venue profiles are covered in Section 9.
- You may not share, sell, or transfer your account.
4. Licence to use the App
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App on a device you own or control, for your personal, non-commercial use (business use of venue features is permitted under Section 9). You may not copy, modify, reverse-engineer, resell, or create derivative works from the App except as permitted by law.
If you obtained the App from the Apple App Store, the Apple-required EULA terms in Section 15 also apply.
5. User content and your responsibilities
"User Content" means anything you post or share through the App — posts, photos, videos, stories, comments, messages, check-ins, meetups, venue submissions, reviews, and profile information.
- You are solely responsible for your User Content and the consequences of sharing it.
- You represent that you own or have the rights to your User Content and that it does not violate these Terms, our Community Standards, any law, or anyone's rights.
- You must not post objectionable content (Section 1), and you must not harass, threaten, deceive, impersonate, or endanger others.
- You must not scrape, harvest, or misuse other users' data, spam, or interfere with the App's operation or security.
Licence you grant us. You keep ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute your User Content solely to operate, provide, and improve the App (for example, showing your post to the communities you share it with). This licence ends when you delete the content or your account, except for content others have re-shared or copies we must keep for legal or safety reasons.
6. Reporting, blocking, and enforcement
- Every piece of user content and every profile includes a way to Report it; every user can be Blocked.
- We may remove content, hide content, warn, suspend, or permanently ban users who violate these Terms or the Community Standards, and we act on reports of objectionable content within 24 hours (Section 1).
- We may report unlawful content or conduct — including any content that sexually exploits or endangers a minor — to law enforcement and relevant authorities.
- Enforcement decisions are at our discretion. If you believe we made a mistake, contact us (Section 16).
7. Location, check-ins, and meeting people in the real world
- The App uses your device location, only while you are using the App, to check you in to nearby venues and show nearby Hot Spots. Location is handled as described in our Privacy Policy and is not shared with other users outside of a check-in you choose to make.
- Hot Spots helps you meet people at real places. You are responsible for your own safety. Meet in public, tell someone where you are going, and use good judgment. We do not verify users' identities and are not responsible for others' conduct, online or offline.
8. Bookings, offers, meetups, and events
- Bookings, offers, meetups, and events are arranged between you and venues or other users. We are not a party to those arrangements and are not responsible for them.
- Venues set their own booking rules, offers, and cancellation terms. Any payments, where offered, are subject to the applicable payment provider's terms.
9. Business and venue profiles
If you register, claim, or manage a business/venue profile, you additionally represent that you are authorized to act for that venue, that your content is accurate and lawful, and that you will comply with these Terms and any additional business terms we provide. We may verify, suspend, or remove venue profiles and submissions.
10. Our intellectual property
The App, the "Hot Spots" name and logo, and all related software, design, and content (other than User Content) are owned by us or our licensors and are protected by law. These Terms do not grant you any rights in them except the limited licence in Section 4.
11. Third-party services
The App may link to or rely on third-party services (for example, maps, payment, or a venue's own website). We are not responsible for third-party services or content; your use of them is governed by their terms.
12. Termination and account deletion
- You may delete your account at any time from within the App (Settings → Delete Account). Deletion permanently removes your account and associated content, subject to copies we must retain for legal or safety reasons.
- We may suspend or terminate your access at any time if you violate these Terms, if required by law, or to protect the App or its users.
13. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or secure, or that content is accurate or reliable. We are not responsible for User Content or for interactions between users.
14. Limitation of liability
To the fullest extent permitted by law, we and our affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
15. Apple App Store — required EULA terms
If you download the App from the Apple App Store, you acknowledge and agree that: (a) these Terms are between you and us only, not Apple; (b) Apple has no obligation to provide maintenance or support for the App; (c) Apple is not responsible for any product warranties, claims, or losses relating to the App; (d) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you; and (e) you comply with applicable third-party terms and confirm you are not located in an embargoed country or on a prohibited-parties list. Your licence to use the App is a Licensed Application licence per Apple's standard EULA, as supplemented by these Terms.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the App. Your continued use after changes take effect means you accept the updated Terms.
17. Governing law and disputes
These Terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of Dubai, United Arab Emirates, unless mandatory local law (including consumer-protection law in your country of residence) provides otherwise.
